The Mozaiko pass is sold by Baptiste Levesque, sole trader (entrepreneur individuel, EI), 49 rue de Bazeilles, 33400 Talence, France. SIREN 534 834 668. EU VAT number: FR50534834668. Contact: support@mozaiko.app. These terms apply to any purchase of the pass by a consumer. This English version is a courtesy translation: the French version prevails.
The pass
Mozaiko is free: each game's daily puzzle and the first grids of each level are free. The pass is a one-time purchase, with no subscription. It unlocks every grid of every Mozaiko game, random grids included, as well as games added later, at no extra cost. What it includes is shown in the app before you buy.
Price
The price is the one shown in the app when you buy, all taxes included, in your store's currency. It may change for future purchases; a pass you've already bought stays yours, with nothing more to pay.
Purchase and payment
The pass is bought in the app, from the pass page. Payment, invoice and refund go through the App Store (Apple) or Google Play (Google), with your store account, under their own terms, which apply in addition to these ones. We receive no payment information.
These terms don't reduce any of your legal rights. If you're a minor, you buy with your parents' agreement.
Access to the pass
The pass is active as soon as the store confirms the payment. It's tied to your App Store or Google Play account, not to your phone: on a new phone with the same store, "Restore purchases", in the settings, gets it back. A pass bought on the App Store doesn't carry over to Google Play, or the other way round. Your progress stays on your phone. The pass has no time limit.
Withdrawal and refund
You have 14 days after the purchase to change your mind, without giving a reason.
App Store: request a refund at reportaproblem.apple.com. Google Play: within 48 hours, from your Google Play order history; after that, write to us at support@mozaiko.app with your order number, and we refund you within 14 days. If a request doesn't go through within that time, write to us as well.
A refund removes the pass.
Legal guarantee
The pass and the games must work as described. If they don't, you benefit from the legal guarantee of conformity for digital content and services (articles L224-25-1 and following of the French consumer code): the defect is fixed free of charge, or, if that isn't possible, you get a price reduction or a refund. Write to support@mozaiko.app.

The consumer has two years from the supply of the digital content or digital service to obtain the implementation of the legal guarantee of conformity if a lack of conformity appears. For one year from the date of supply, the consumer only has to establish that the lack of conformity exists, not the date it appeared.
The legal guarantee of conformity entails the obligation to supply all the updates needed to keep the digital content or digital service in conformity.
The legal guarantee of conformity entitles the consumer to have the digital content or digital service brought into conformity without undue delay following their request, free of charge and without significant inconvenience to them.
The consumer may obtain a price reduction while keeping the digital content or digital service, or may end the contract and be fully refunded in return for giving up the digital content or digital service, if:
1° The trader refuses to bring the digital content or digital service into conformity;
2° Bringing the digital content or digital service into conformity is unjustifiably delayed;
3° The digital content or digital service cannot be brought into conformity without costs imposed on the consumer;
4° Bringing the digital content or digital service into conformity causes significant inconvenience to the consumer;
5° The lack of conformity of the digital content or digital service persists despite the trader's unsuccessful attempt to bring it into conformity.
The consumer is also entitled to a price reduction or to terminate the contract when the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to ask first for the digital content or digital service to be brought into conformity.
Where the lack of conformity is minor, the consumer is entitled to cancel the contract only if the contract does not provide for the payment of a price.
Any period during which the digital content or digital service is unavailable while it is being brought into conformity suspends the remaining guarantee period until the digital content or digital service is supplied in conformity again.
The rights above result from articles L. 224-25-1 to L. 224-25-31 of the French consumer code.
A trader who obstructs in bad faith the implementation of the legal guarantee of conformity incurs a civil fine of up to 300,000 euros, which may be raised to 10% of the average annual turnover (article L. 242-18-1 of the French consumer code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French civil code, for two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the digital content or digital service is kept, or to a full refund in return for giving up the digital content or digital service.

Complaints and mediation
First write to reclamation@mozaiko.app: we reply within 30 days at most. Then, if needed, you can refer the matter free of charge to the consumer mediator CM2C, 49 rue de Ponthieu, 75008 Paris, France, litiges@cm2c.net, www.cm2c.net (details in the legal notice).
Applicable law
These terms are governed by French law. Failing an amicable agreement, French courts have jurisdiction under ordinary rules. You keep the protections given by the law of your country of residence.
Changes
These terms may change. Those in force on the day of your purchase apply to that purchase.
